Welcome to Kelenz ("we", "our" or "us"). By accessing or using our mobile application, website or services (collectively, the "Services"), you agree to be bound by the following Terms and Conditions. 1. Eligibility
You must be at least 13 years old to use Kelenz. If you reside in France and are between 13 and 15 years old, you must obtain the prior consent of a parent or legal guardian, as required by Article 8 of the General Data Protection Regulation. Users between 15 and 18 are also encouraged to inform their legal representative of their registration. By using our Services, you represent and warrant that you meet these requirements and have, where applicable, obtained the necessary parental authorisations.
2. Account Registration and Profiles
To access the platform's features you must create an account via email/password or via a third-party identity provider (Google, Apple). Kelenz offers four profile types: Athlete (player), Coach (trainer), Club (sports organisation, accessible only through the web dashboard) and Fan (supporter). You agree to provide accurate, up-to-date and complete information (notably your first name, last name, date of birth and, where applicable, your sport, position or club name), to keep your credentials secure, and not to share access to your account. You are responsible for all activity carried out through your account. One account per individual; one Club account per organisation.
3. Acceptable Use
You agree to use Kelenz lawfully, respecting the rights of others and the spirit of the sports community. You must not:
- violate any applicable law or regulation, or infringe third-party rights (image rights, copyright, trademarks, privacy)
- post unlawful, hateful, violent, pornographic, child-sexual, harassing, defamatory, misleading or rights-infringing content (images, videos, captions, messages, achievements, statistics)
- impersonate another person or organisation, create fake profiles, attempt to gain unauthorised access to our systems, bypass technical protection measures, or use automated means (bots, scripts) to interact with the Services
- harass, threaten or intimidate other users, or send spam or unsolicited commercial messages via direct messaging or comments
- extract, copy, index or reuse other users' content or Kelenz databases in an automated manner, except as permitted by law
4. User Content, Rights and Licence
You retain ownership of the content you post on Kelenz (photos, videos, captions, biographies, achievements, sports stats, career history, messages). By posting, you grant Kelenz a worldwide, non-exclusive, royalty-free licence limited to the duration necessary to operate the service, to host, display, resize, transcode and distribute that content to other users and visitors for the sole purpose of providing the Services. You warrant that you hold all the rights to the content you post (including image rights of identifiable individuals and rights to third-party works) and agree to indemnify Kelenz against any related claim. You may delete your content at any time from within the app; deletion triggers the removal of technical caches and copies within a reasonable timeframe.
5. Direct Messaging
Kelenz offers a private 1:1 messaging service (text, images, videos). Messages are stored on our servers and are not end-to-end encrypted: do not share information requiring absolute confidentiality (passwords, bank details, medical data). Messages remain visible to both participants until the conversation is deleted. You may delete a message or an entire conversation at any time; attached media are then removed from storage. Any conversation may be reported (see Moderation).
6. Moderation, Blocking and Reporting
You have several tools to control your experience: block a user (breaks follow links, mutually hides profiles and prevents new messages), mute a user (silences their notifications and hides their posts from your feed), and report a user, a post or an issue via the dedicated menu. Kelenz reviews reports and may, at its sole discretion, remove content, suspend an account or terminate a subscription in case of violation of these Terms or applicable law. Decisions are made case by case and may take effect without prior notice in case of urgency. In accordance with the EU Digital Services Act (DSA), we endeavour to process reports within a reasonable timeframe and to provide the reason for any content removal to its author.
7. Profile Verification (Optional)
You may request verification of your profile by submitting a supporting document (ID, sport licence, coach contract, club articles). The document is reviewed by our team and deleted immediately after processing (acceptance or rejection), in line with the data minimisation principle. Verification grants a badge displayed on your profile; it is not required to use the Services. Any fraudulent submission may result in account suspension.
8. Club Membership
Club accounts have a unique 8-character access code, generated automatically and regeneratable at any time from the dashboard. To join a club, an athlete, coach or fan enters this code in the mobile app. A user may leave a club at any time; the club may also remove a member from its dashboard, which triggers a notification to the user concerned. Membership history is retained internally as an end-of-membership marker, for aggregate statistics and abuse prevention, with no public visibility.
9. Subscriptions and Paid Plans (Clubs)
Kelenz offers subscription plans reserved for Club accounts: Free, Pro and Premium. The Free plan is granted by default at Club account creation and provides a limited number of members, teams, matches and achievements. Pro and Premium plans extend these limits, unlock analytics features (notably profile views) and grant access to live-chat support. Current pricing and per-plan limits are displayed on the subscription page of the Club dashboard. Paid subscriptions auto-renew on the chosen billing cycle (monthly or yearly) until cancellation. Kelenz may change pricing; any change is communicated in advance and takes effect at the next cycle. Athlete, Coach and Fan accounts have free access to all features designed for them.
10. Payment Processing
Payments are processed by our provider Stripe, Inc., in a PCI DSS compliant environment. By subscribing, you also agree to Stripe's terms of service. Kelenz does not collect, store or have access at any time to your payment information (card number, expiration date, security code). Kelenz only retains the technical identifiers necessary to manage the subscription: Stripe customer ID, subscription ID, plan, status and billing period dates.
11. Cancellation, Withdrawal Right and Refunds
You may cancel your paid subscription at any time via the Stripe portal accessible from your Club dashboard. You retain access to the plan until the end of the current billing period, after which your account automatically reverts to the Free plan. No prorated refunds are issued unless required by applicable law. Under Article L. 221-28 of the French Consumer Code, by subscribing and immediately accessing paid features, you expressly waive your 14-day withdrawal right that would otherwise apply to distance contracts.
12. Public Profiles and Visibility
By creating a Kelenz account, you agree that your profile will be publicly accessible on kelenz.com. The information displayed (name, photo, sport, position, city, biography, statistics, career, achievements, team and club) is visible to any visitor and indexable by search engines (Google, Bing, etc.). This public visibility is inherent to Kelenz operating as a sports social network and enables connections between athletes, coaches, clubs and fans. You may delete your account at any time: your profile is then immediately removed from the website and progressively deindexed by search engines.
13. Third-Party Links and Services
Some profiles, articles or match pages may include links to third-party sites (official website, Instagram, X, ticketing, live streaming). These links are not under our control; we accept no responsibility for their content, privacy practices or terms. Access to these sites is at your sole risk.
14. Personal Data
Your use of the Services is also governed by our Privacy Policy, which details the data collected, purposes, legal bases, processors and your rights. We strongly encourage you to read it carefully before creating an account.
15. Termination and Account Deletion
You may delete your account at any time from within the mobile app (Settings). Deletion is immediate and triggers the definitive and irreversible erasure of all your personal data, posts, media, messages and social links, subject to applicable legal retention periods (see Privacy Policy). If you have an active paid subscription, deletion triggers immediate cancellation with no refund. Kelenz reserves the right to suspend or terminate your account, without prior notice, in case of breach of these Terms, of applicable law or for any legitimate reason.
16. Warranties and Limitation of Liability
Kelenz is a sports networking platform provided "as is" and "as available". We do not guarantee continuous or uninterrupted availability, nor the accuracy of information posted by users (statistics, career, achievements). Kelenz does not organise or supervise the sports activities that may result from introductions made via the platform: any sports practice is at your sole responsibility and, where applicable, that of the relevant club or supervisor. To the fullest extent permitted by law, Kelenz shall not be liable for indirect, incidental or consequential damages arising from use of the Services, nor for injuries or incidents occurring during a sports activity.
17. Modifications to These Terms
We may update these Terms at any time to reflect changes in the Services, the legal framework or our practices. Material changes are notified via the app or by email at least 15 days before they take effect. The effective date at the top of this page is updated with each revision. Continued use of the Services after a new version takes effect constitutes acceptance of the new terms.
18. Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute relating to their formation, performance or interpretation will be submitted to the competent French courts, subject to mandatory provisions applicable to consumers residing in the European Union. You may also use the European online dispute resolution platform (ec.europa.eu/consumers/odr) or refer the matter to a consumer mediator.
